1. Acceptance of Terms

By accessing or using Bondly, you agree to comply with and be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. You represent that you have the legal capacity to enter into these Terms.

2. Eligibility

To use Bondly, you must:

• Be at least 18 years of age
• Be legally permitted to use our services under the laws of your jurisdiction
• Not be prohibited from using our services under any applicable laws
• Not have been previously banned or suspended from Bondly
• Provide accurate and truthful information during registration

3. Account Registration and Security

3.1 Account Creation

You must create an account to use Bondly. When creating your account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Maintain the security of your account credentials
• Not share your account with anyone else
• Notify us immediately of any unauthorized access or security breach

3.2 Account Responsibility

You are responsible for all activity that occurs under your account. You agree to notify Bondly immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct and Prohibited Activities

4.1 Community Standards

Bondly is a community built on respect, safety, and genuine connections. You agree to:

• Treat all users with respect and courtesy
• Use the platform for its intended purpose of making genuine connections
• Report any inappropriate behavior or content
• Respect other users' boundaries and privacy
• Comply with all applicable laws and regulations

4.2 Prohibited Content and Behavior

You agree NOT to post, share, or engage in the following:

• Harassment or Abuse: Threatening, harassing, stalking, or intimidating other users
• Hate Speech: Content that promotes hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Nudity and Sexual Content: Explicit sexual content, nudity, or sexually suggestive material
• Violence: Content promoting or glorifying violence or self-harm
• Spam and Scams: Spam, phishing attempts, fraudulent schemes, or pyramid schemes
• Impersonation: Pretending to be someone else or creating fake profiles
• Minors: Any content involving minors in a romantic or sexual context
• Illegal Activity: Promoting or engaging in illegal activities
• Commercial Solicitation: Using the platform for unauthorized commercial purposes or advertising
• Bots and Automation: Using bots, scripts, or automated tools to interact with the service

5. Content Ownership and Rights

5.1 Your Content

You retain ownership of all content you post on Bondly, including photos, messages, profile information, and other materials ("Your Content"). By posting Your Content, you grant Bondly a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display Your Content solely for the purpose of providing and improving our services.

5.2 Content Removal

Bondly reserves the right to remove, edit, or disable access to any content that violates these Terms or is otherwise objectionable, without prior notice. We are not obligated to monitor or review user content but may do so at our discretion.

5.3 Bondly's Content

All content provided by Bondly, including the application interface, design, logos, trademarks, and functionality, is owned by Bondly and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our services.

6. Subscription and Payments

6.1 Subscription Plans

Bondly offers both free and premium subscription plans. Premium features may include:

• Unlimited likes and matches
• Advanced search filters
• Ability to see who liked your profile
• Boost features to increase visibility
• Ad-free experience
• Priority customer support

6.2 Payment Terms

By purchasing a subscription, you agree to:

• Provide accurate and complete payment information
• Pay all applicable fees and taxes
• Authorize automatic recurring billing for subscription renewals
• Our use of third-party payment processors (M-Pesa, credit cards, etc.)

6.3 Refunds and Cancellations

Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time through your account settings, and you will continue to have access to premium features until the end of your billing period.

6.4 Price Changes

Bondly reserves the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal unless you cancel before the renewal date.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using Bondly, you consent to our data practices as described in the Privacy Policy.

8. Safety and Reporting

8.1 User Safety

While we strive to maintain a safe environment, Bondly cannot guarantee the conduct of users. You agree to:

• Exercise caution when meeting users in person
• Meet in public places for initial meetings
• Inform friends or family of your plans
• Never send money to users you have not met in person
• Trust your instincts and report suspicious behavior

8.2 Reporting Mechanisms

If you encounter inappropriate behavior, content, or have safety concerns, please report it immediately through the app or by emailing safety@bondly.app. We take all reports seriously and investigate promptly.

9. Termination and Suspension

9.1 Termination by You

You may delete your account at any time through the app settings. Upon deletion:

• Your profile will be removed from Bondly
• Your matches and conversations will be deleted
• You will lose access to all premium features
• Certain information may be retained as described in our Privacy Policy

9.2 Termination by Bondly

Bondly reserves the right to suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your account poses a safety or security risk
• We are required to do so by law
• We discontinue the service (with reasonable notice)

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimer

Bondly is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:

• The quality, accuracy, or reliability of the service
• Uninterrupted or error-free operation
• The conduct or compatibility of users you meet
• The security of your data or communications
• The results you may obtain from using the service

10.2 Limitation of Liability

To the fullest extent permitted by law, Bondly and its officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• User conduct or content
• Third-party actions or omissions

Our total liability to you for all claims arising from your use of Bondly shall not exceed the amount you paid us in the twelve months preceding the claim, or KES 10,000, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bondly and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Your Content posted on Bondly
• Any fraudulent or illegal activity

12. Dispute Resolution and Arbitration

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles.

12.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of Bondly, you agree to first attempt to resolve the dispute informally by contacting us at legal@bondly.app. We will work in good faith to resolve the matter within 30 days.

12.3 Arbitration

If informal resolution is unsuccessful, any disputes shall be resolved through binding arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

12.4 Class Action Waiver

You agree to resolve disputes with Bondly on an individual basis and waive your right to participate in class actions or representative proceedings.

13. Modifications to Terms

Bondly reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date
• Notify you through the app or via email
• Provide a reasonable period to review the changes
• Request your acceptance of the updated Terms

Your continued use of Bondly after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service and delete your account.

14. Intellectual Property

All intellectual property rights in Bondly, including but not limited to trademarks, service marks, logos, trade names, software, technology, and content, are owned by or licensed to Bondly. You may not use our intellectual property without our prior written consent.

15. Third-Party Services

Bondly may integrate with or provide links to third-party services such as:

• Social media platforms (Facebook, Instagram)
• Payment processors (M-Pesa, credit card gateways)
• Location services
• Analytics providers

Your use of third-party services is subject to their respective terms and policies. Bondly is not responsible for third-party services or their practices.

16. Force Majeure

Bondly shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or internet service failures.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Bondly regarding your use of the service and supersede all prior agreements and understandings.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Bondly may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

20. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.
